Digital Fine Art Print License Terms & Conditions
1. License Grant for selected Images
Upon payment of the applicable fee, Bernhard Esterer (“Licensor”) grants the purchaser (“Licensee”) a non-exclusive, non-transferable license to download the selected digital photograph (“Image”) for the sole purpose of printing one (1) physical Fine Art print in the chosen size (A2, A1, or A0).
2. Pricing & Sizes
- A2 (42 × 59.4 cm) – USD 272.- per image
- A1 (59.4 × 84.1 cm) – USD 386.-per image
- A0 (84.1 × 118.9 cm) – USD 556.- per image
3. Permitted Uses
The Licensee may:
- Download the purchased Image in the chosen print-ready resolution.
- Print one (1) Fine Art print for personal display.
- Re-print the Image for personal replacement purposes only (e.g., if the original print is damaged. Proof of damage needs to be confirmed by Bernhard Esterer before re-print).
4. Prohibited Uses
The Licensee may not:
- Print the Image for resale or commercial distribution.
- Use the Image in advertising, merchandise, or any commercial products.
- Share, resell, or distribute the digital file.
- Modify the Image in any way that misrepresents the artist’s work.
- Claim copyright or authorship of the Image.
5. Copyright & Ownership
All copyrights and intellectual property rights remain the sole property of Bernhard Esterer. Purchase grants a print license only. No ownership or copyright is transferred.
6. Payment & Delivery
- Full payment must be received before download access is granted.
- Each Image is licensed individually. A separate license is required for each Image.
7. Refunds & Cancellations
Due to the digital nature of the product, all sales are final. No refunds or exchanges are available once the file has been downloaded.
8. Termination
Any breach of these Terms will result in automatic termination of the license without refund. Continued unauthorized use may result in legal action.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of South Africa, and any disputes shall be resolved under its jurisdiction.
